A will is more than a formal declaration concerning the disposal of property after death. It protects your assets and ensures your beneficiaries maximise their gift from you. If you are purchasing or own a property in Spain, we recommend to make a will to facilitate the distribution of your assets in Spain.
In the Spanish legal system, there are rules governing the distribution of property after death.

There are two different types of successions:

A. Testate Succession which arises when the deceased person has expressed his wishes in the form of a will.

B. Intestate Succession which arises when a person dies without making a will. Under these circumstances Spanish law will apply and distribute your estate which may be done in a way that is against your wishes and cause unnecessary delay.
In Spain, the signing of wills must be made by the testator in the presence of a Public Notary. A copy will be kept by him and an additional copy will be filed with the central wills register in Madrid.
    

When you decide to contact us, we can:

1. Offer advice and guidance in the preparation or revision of your will. (A post-dated UK will revokes a Spanish will unless catered for.)

2. Offer advice on Inheritance Tax and explain the distribution of your estate after death.

3. Accompany you to the Notary Office when you sign your Spanish will.

4. Assist you with Spanish inheritance tax in whether a will does or does not exist.

5. Advise you on Inheritance Tax planning and the creation and administration of Trusts.
Our legal fees in the administration of a deceased estate will vary according to the individual circumstances of a case. When you contact us we will discuss the individual circumstances of your case, and we will be pleased to give you an estimation of our legal fees, the amount of inheritance tax and other costs that may be involved.

Our standard fees for the preparation and notarising a Spanish Will is 200 Euros (16 % VAT and notary fees included) and 360 Euros for two Wills (16 % VAT and notary fees included).
